These Terms and Conditions apply to purchases, bookings and enquiries made through www.eurotachographsolutions.ie.
This website is operated by Nugent ETS Limited, trading as Euro Tachograph Solutions (“ETS”, “we”, “us” or “our”), an Irish limited company registered under company number 627183.
Our contact details are:
- Address: Unit 1, Cessna Avenue, Airport Business Park, Waterford, Ireland, X91 FV06
- Email: info@eurotachographsolutions.ie
- Telephone: +353 51 348331
By placing an order or booking a service, you agree to these Terms and Conditions. Nothing in these terms affects the statutory rights available to consumers under Irish law.
1. Products and services
ETS sells tachograph download tools, card readers, accessories and other transport-related products through our online shop.
We also supply workshop and calibration equipment by quotation or direct arrangement. Training courses, tachograph calibration, analysis, technical support and related services may be booked separately. Training and workshop services are generally provided at our premises in County Waterford unless otherwise agreed.
The description, price and main features of each online product will be displayed on its product page. Details of equipment or services supplied outside the online shop will be set out in the relevant quotation, booking confirmation or written agreement.
Product images are for illustration. Packaging, colours and minor specifications may differ. You are responsible for checking that a product is suitable and compatible with your vehicle, equipment, software and intended use before ordering. Please contact us if you require compatibility advice.
2. Orders and quotations
An online order is an offer to purchase from us. After receiving an order, we will normally send an acknowledgement email. A binding contract is formed when we confirm or dispatch the order.
Workshop equipment, installations and other products or services supplied by quotation are subject to the prices, specifications, payment terms and validity period stated in that quotation.
We may refuse or cancel an order if:
- A product is unavailable;
- The price or description contains an obvious error;
- Payment cannot be authorised;
- We cannot deliver to the requested location;
- We reasonably suspect fraud or misuse; or
- The order does not meet applicable legal, technical or safety requirements.
If we cancel an order after receiving payment, we will refund the relevant amount.
3. Prices, VAT and payment
Prices are displayed in euro. VAT is added at checkout where applicable. Delivery charges and any other mandatory charges will be shown before you complete your order.
Payment must be made using one of the payment methods offered at checkout. By submitting payment details, you confirm that you are authorised to use the selected payment method.
Orders or services supplied by quotation may be subject to separate deposits, staged payments or credit terms. These will be confirmed in writing before the order or booking is accepted.
Overdue business invoices may be subject to statutory interest and recovery costs where applicable.
4. Delivery
Available delivery methods, charges and estimated delivery times will be displayed during checkout or confirmed in writing.
Delivery dates are estimates unless expressly agreed otherwise. You must provide a complete and accurate delivery address. We are not responsible for delays or losses caused by incorrect information supplied by you.
Please inspect goods promptly after delivery and notify us as soon as reasonably possible if anything is missing, damaged or incorrect. This does not limit your statutory rights.
Ownership of goods passes to you once we have received full payment. Risk passes when the goods are delivered to you or to a person nominated by you, subject to applicable consumer law.
5. Consumer cancellation rights
This section applies when you purchase mainly for personal use rather than for a trade, business, craft or profession.
For most online purchases, consumers may cancel without giving a reason:
- For goods: within 14 days after receiving the goods; or
- For services: within 14 days after the service contract is agreed.
To cancel, email info@eurotachographsolutions.ie or write to Euro Tachograph Solutions, Unit 1, Cessna Avenue, Airport Business Park, Waterford, Ireland, X91 FV06. You may use the cancellation form at the end of these terms, but you do not have to.
Goods must normally be returned within 14 days after notifying us of cancellation. Unless the goods are faulty or we agree otherwise, you are responsible for the direct cost of returning them.
You may examine goods as you would in a shop, but you should not use or handle them more than necessary. We may reduce a refund to reflect a loss in value caused by unnecessary handling.
Refunds will be made within the period required by law and normally using the original payment method. For returned goods, we may wait until we receive the goods or receive evidence that they have been returned.
The cancellation right may not apply to:
- Goods made to your specifications or clearly personalised;
- Sealed goods unsuitable for return for health or hygiene reasons once opened;
- Services fully completed during the cancellation period where you requested early performance and acknowledged that your cancellation right would end; or
- Other products or services excluded from cancellation under applicable law.
6. Returns and faulty products
Our separate Refunds and Returns Policy provides information about returning unwanted items. Any goodwill returns period operates in addition to your statutory rights.
Goods and services supplied to consumers must comply with applicable Irish consumer law. If something is faulty, not as described, not fit for its intended purpose or otherwise fails to conform to the contract, you may be entitled to repair, replacement, a price reduction, refund or termination of the contract, depending on the circumstances.
To report a problem, email info@eurotachographsolutions.ie with your order number, a description of the issue and, where helpful, photographs or other supporting information.
Nothing in these terms excludes or restricts a statutory remedy that cannot lawfully be excluded.
7. Training courses and appointments
Training places and workshop appointments are subject to availability. A booking is confirmed when we issue written confirmation and receive any required payment or deposit.
You must provide accurate attendee, vehicle and equipment information and cooperate reasonably with us when we provide a service.
If you need to cancel or rearrange a course or appointment, please contact us as early as possible. Any cancellation or rescheduling conditions will be communicated when the booking is made. Any charge applied will be reasonable and will not override mandatory consumer rights.
We may reschedule a course or appointment because of instructor illness, equipment availability, safety concerns or circumstances outside our reasonable control. Where this happens, we will offer a replacement date or an appropriate refund.
8. Compliance responsibilities
Our products, training, tachograph analysis and compliance information are intended to support your operations. Unless expressly agreed in writing, they do not transfer your legal or regulatory responsibilities to ETS.
You remain responsible for:
- Operating vehicles and equipment lawfully;
- Maintaining complete and accurate records;
- Completing required downloads, inspections and calibrations;
- Following applicable tachograph, drivers’ hours, transport and working-time rules;
- Acting on compliance reports, warnings and recommendations; and
- Obtaining professional advice where required.
Advice or training is based on the information available at the time it is provided. Laws, official guidance and technical requirements may change.
9. Business customers
A business customer is someone purchasing wholly or mainly for trade, business, craft or professional purposes. Statutory consumer cancellation rights do not apply to business purchases.
For business customers only, and to the maximum extent permitted by law:
- We are not liable for loss of profit, revenue, contracts, anticipated savings, business opportunity, goodwill or data, or for indirect or consequential losses;
- Our total liability arising from an order or service will not exceed the amount paid or payable for the affected product or service during the preceding 12 months; and
- You are responsible for confirming that our products and services meet your operational, technical and regulatory requirements.
These restrictions do not apply where liability cannot legally be limited or excluded.
10. General limitation of liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be limited.
For consumers, we are responsible for losses that are a reasonably foreseeable result of our breach. We are not responsible for business losses suffered by someone purchasing as a consumer.
We are not responsible for delays or failures caused by events outside our reasonable control. We will take reasonable steps to notify affected customers and minimise the effects.
11. Intellectual property
All website content, branding, graphics, photographs, videos, software and training materials are owned by or licensed to Euro Tachograph Solutions and are protected by intellectual property law.
Materials supplied as part of a purchase or course may be used only for their intended purpose. They may not be copied, published, sold or distributed without our prior written permission.
12. Privacy
We process personal information in accordance with our Privacy Policy.
Information about cookies and available choices is provided through the website’s cookie notice and preference controls.
13. Complaints
Please send complaints to:
- Email: info@eurotachographsolutions.ie
- Telephone: +353 51 348331
- Address: Unit 1, Cessna Avenue, Airport Business Park, Waterford, Ireland, X91 FV06
We will acknowledge and attempt to resolve complaints within a reasonable period.
14. Changes to these terms
We may update these terms occasionally. The terms in force when you place an order or make a booking will apply to that transaction.
15. Governing law
These terms are governed by Irish law.
If you are a consumer living elsewhere in the European Union, you retain the benefit of any mandatory consumer protection available under the law of your country of residence.
The Irish courts will have jurisdiction, subject to any mandatory right a consumer has to bring proceedings elsewhere.
16. General provisions
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
A delay in enforcing a right does not waive that right.
